Tomorrow the Dutch parliament will discuss the new Dutch model text for bilateral investment treaties. These treaties are controversial as they contain investor-to-state dispute settlement, or ISDS.

In a letter to the chairman of the trade committee (BuHaOS), Vrijschrift writes that the model text consolidates fundamental defects and gives the United States a major influence on the dispute settlement mechanism. Vrijschrift also notes that under the text investment arbitrators can assess compliance with the WTO TRIPS treaty, and thus interpret this treaty, while the WTO has its own dispute resolution mechanism. In addition, the government has not made use of a safeguard for personal data in investment treaties established by the European Commission.

Zeer geachte heer De Roon,

Wij schrijven u met betrekking tot de handelsverdragen met Japan en Singapore. Deze verdragen vallen onder de bevoegdheid van de EU; ratificatie door Nederland is niet nodig. De EU kan al op 26 juni besluiten de verdragen te tekenen. Wij menen dat de Kamer een parlementair onderzoeksvoorbehoud dient te maken.

Het wordt de laatste tijd duidelijker dat de bescherming van persoonsgegevens niet alleen een zaak van burgerrechten is. Het schandaal rond Facebook heeft duidelijk gemaakt dat ook de integriteit van onze instituties op het spel staat. Terecht willen de Europese Commissie en Europese politici (bijvoorbeeld Merkel en Verhoeven) grotere algoritmische transparantie. Echter, de broncodeclausule van het verdrag met Japan zal het onderzoeken van algoritmes ondermijnen. Een duidelijk conflict tussen belangrijk beleid en een handelsverdrag. ¹

Welcome everyone, 

I’m Ante Wessels. I’m involved with Vrijschrift and the Foundation for a Free Information Infrastructure. I will give a short talk about investor-to-state dispute settlement, or ISDS. Why is ISDS important? 

Investor-to-state dispute settlement gives multinationals the right to sue states before special tribunals if changes in law may lead to lower profits than expected. Multinationals can challenge reform of copyright and patent law, challenge environmental and health policies. 

How does the ISDS system work? 

International trade and investment agreements give foreign investors greater rights than local companies, even expected future profits are protected. 

On top of that, foreign investors do not have to use the local court system. Arbitration tribunals consisting of three investment lawyers decide the cases. These tribunals can overturn decisions of our supreme courts.
